Terms of Service

GENERAL
• I am free to decline any employment offer if I'm not comfortable with it.
• I won't make any refunds once the fee is paid. So please be aware of that. Chargebacks are prohibited.
• Do's: OC, fanart, soft gore/artistic nudity, real people. Dont's: hard porn or NSFW, graphic violent content, NFT, mecha. Furry and animal art are outside my confort zone so these type of commissions may require extra study on my part, still, I accept them with an extra fee applied.PAYMENTS
• The deposits are made via Paypal invoices. In VGen, they will be made through the platform payment options.
• I will ask for 100% of the payment before I start drawing. Payment plans are accesible if the pricing exceeds $100.
• I won't make any refunds once the fee is paid. So please be aware of that. Chargebacks are prohibited.REVISIONS
• The client has freedom to make any changes on the sketch phase.
• Once the lineart and coloring phase is completed and approved, they will have 3 free opportunities for small modifications.DEADLINES AND DELIVERY
• I'm a full time graphic design student and I also work on conventions independently, so the delivering times may vary depending on queue and personal life situations.
• After the payment is made, I will take a 2-4 weeks time period to start working on your commission. (This is subject to circumstances that will be communicated if necessary).USE
• The commissions' base prices are for personal use only. You may print your commission if you plan on using it for yourself or give it away as a gift, you can also use it as avatar/icon or post it on your non-monetized social media.If you plan on using your commission for other projects, you would have to consider buying one the following licenses:
• Digital Commercial use: +80% of total price. The client may use the artwork for monetized plataforms like Twitch, Youtube, TikTok, Whattpad, Webtoon, etc. ; Streaming graphics (Loading screen, schedule, social media, banner, etc.) Cover art (Music album; Light novel and Comic when monetized, digital books' covers, etc.). Twitch emotes include this license in the final pricing.
• Physical Commercial use: +120% of total price. The client may utilize the artwork for physical merchandise or goods such as: keychains, posters, postcards, mugs, published books, etc.The licenses can be purchased after the artwork has been finished. For example, if the customer bought a commission for personal use but a few months later decided to start using it for selling and producing physical merchandise, they must buy a Physical Commercial use license before doing so.Please be honest about the way in which you plan on using the artwork to avoid legal repercussions.CLIENTS' FACULTIES
After commissioning the artwork, the client may:
• Print the art for themselves, use it as avatar/icon or post it in their social media (with credit and as long as your social media is not monetized), or give it away as a gift (personal use license).
• Use it for all of the above and monetized digital platforms (digital commercial use license).
• Use it for all of the above and production of physical merchandise (physical commercial use license).After commissioning the artwork, the client may NOT:
• Take credit for the artwork, trace it, recolor it, remove, cover or modify my signature.
• The production of derivative content is STRICTLY PROHIBITED (AI generated media of any kind). As well as the use of my artwork in any blockchain-related technology, including NFTs, cryptocurrencies, or future inventions.INTELLECTUAL PROPERTY RIGHTS
• If the physical commercial rights weren't previously bought by the client, they are owned by me, the artist. I may print, sell and/or reproduce the commissioned art. In case I decide to do so, I will directly ask for the client's consent and respect their decision.
• I am allowed to show and/or upload all commissions' process and final result to my social media (Twitter/Twitch/Instagram/etc.) unless the client explicitly asks me not to do so.COMMUNICATION
• For organization purposes, I will communicate with the client through ONE (1) social media platform (E-mail, Twitter, Instagram, Discord, etc). The client must provide at least TWO (2) communication options in case the first one fails.
• The client is free to make any questions or comments but must remain respectfull. In case I feel disrespected or uncomfortable, I own the right to stop working on the commission for an undefined period of time (I won't make any refunds once the fee is paid) or until real and honest reparations are made. This is, however, an extreme measure I wouldn't wish to take.EXTRAS
• Detailed backgrounds (+ 5 to 40 USD)
• Detailed clothing (+ 3 to 20 USD for each character drawn)
• Urgency (+10% to +20% fee applied to the final price, depending on the timeframe given)
• Outside of my confort zone such as anthro/furry - animal (+$5 to $30)
